Unmarried Couples Separation

When unmarried couples, with children born out of the relationship, decide to go their separate ways, there is often great uncertainty regarding the rights and responsibilities of both parents.

We provide assistance by explaining their rights and responsibilities as co-parents of their children.

Facilitating negotiation between the parties may even include inviting the grandparents to be part of the discussion and mediation process. This scenario is necessary in situations where the parents of the children are still very young and financially dependent on their own parents.

 The purpose of the negotiation process is to guide the parties to reach practical solutions regarding contact and maintenance of the children involved.

The outcome of the negotiations will be compiled into either a parenting plan or a parental rights and responsibilities agreement which can either be registered with the office of the Family Advocate or made an order of court.

It is important to note that the law does acknowledge the rights of unmarried fathers.
